Freedom of Information Act compliance policy

The Moweaqua Public Library District (MPLD) policy is to comply with state statutes on Freedom of Information Act (FOIA) issues (5 ILCS 140/1 et seq).

​

The MPLD Board of Trustees will designate one trustee to act as its FOIA officer. Except in instances when records are furnished immediately, the FOIA officer or their designee shall receive requests submitted to the Board, ensure that the Board responds to requests in a timely fashion, and issue responses according to this policy.

Upon request, the Board shall disclose documents or categories of records in compliance with FOIA policy and observing the exemptions listed therein.

Upon receiving a request for a public record, the FOIA officer shall

  • note the date the public body receives the written request.

  • compute the day on which the period for response will expire and make a notation of that date on the written request.

  • maintain an electronic copy of a written request, including all documents submitted with the request until the request has been complied with or denied.

  • create a file for the retention of the original request, a copy of the response, a record of communications with the requester, and a copy of any other related communications.

 

The FOIA officer shall successfully complete the electronic training curriculum (https://foiapac.ilag.gov/) on an annual basis. Whenever a new FOIA officer is designated, that person shall successfully complete the electronic training curriculum within 30 days of assuming the position. Successful completion of the required training curriculum within the periods provided shall be a prerequisite to continue serving as a FOIA officer.

 

The Board shall prominently display on the library website, make available for inspection and copying, and send through the mail if requested, each of the following:

  • a brief description of itself that will include a short summary of its purpose, the total amount of its operating budget, the Library address, the approximate number of full and part-time employees, and the identification and membership of the Board.

  • a brief description of the methods whereby the public can request information and public records, a directory designating the FOIA officer, the address where requests for public records should be directed, and any fees allowable.

 

The Board shall maintain and make available for inspection and copying a reasonably current list of all types or categories of records under its control. The Board shall, upon request, furnish printed copies of records stored electronically. The public can request information and public records by contacting the library in person, via telephone or email, or via written request delivered or mailed to the library. The library can charge for printing and mailing costs.
